In its judgment, the Federal Administrative Court (the Court) partially upheld the appeal of an Austrian resident against a decision of the IV Office for Insured Persons Residing Abroad (IVSTA) denying entitlement to a Swiss disability pension. The case concerned the assessment of work capacity in the context of Long Covid and chronic fatigue symptoms. The Court found that the multidisciplinary expert report relied upon by the IVSTA contained inconsistencies regarding the claimant’s work capacity and did not sufficiently address the medical evidence relating to fatigue and post-exertional symptom worsening. It further held that indications of a deterioration in the claimant’s health between the expert assessment and the contested decision had not been adequately investigated. The Court therefore set aside the decision and remanded the case for a new multidisciplinary assessment and a fresh decision.
