Decision 2C_234/2026 of 16 September 2026

In its judgment, the Federal Supreme Court (the Court) declared inadmissible an appeal concerning a paediatrician’s handling of a minor child’s medical records and related disciplinary proceedings. The case arose after the child’s father, who shared parental authority, obtained a copy of the child’s medical file and later consulted a hospital regarding the child without the mother being informed.

The appellant argued that the child’s patient rights had been violated because the paediatrician had neither informed the mother of the hospital consultation nor provided the relevant medical information. The Court noted, however, that the child’s mother had already obtained the complete medical file, including the hospital report and the paediatrician’s notes concerning the events in question.

The Court held that the appellant therefore lacked a current practical interest in pursuing the proceedings. As access to the requested medical information had already been granted and no exceptional circumstances justified a review despite the absence of a current interest, the appeal was declared inadmissible.
